An award will be made to a responsive offeror (who submits all required submissions on time), whose past performance does not pose a risk to the Government, and whose offer is Technically Acceptable. An offer is technically acceptable if its technical capabilities conform to the Government's Performance Work Statement or listed specs whichever is applicable to the buy. Offerors understand that the Marketplace ranks all offers by price; however, pursuant to applicable acquisition regulations and/or departmental guidelines, Buyers may use criteria other than price to evaluate offers. Accordingly, please note that, to the extent required by applicable regulations and/or guidelines, award will be made to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Buyer on the basis of price, technical capability, delivery, and past performance.

The Buyer is allowing Sellers to submit bids that either meet or exceed the requested specification. Sellers MUST enter exactly what they are bidding (including make, model, and description) into the blank description field in order for the bid to be considered.

The Buyer is requiring that any rebid must be lower than the 'current bid price' by this amount. The reduction is based on the total order and must be satisfied within the rebid minimum.

Buyer intends to issue award using a purchase order, delivery order, or purchase card. If utilizing a purchase card, Buyer will communicate account information to Selected Seller outside of the Marketplace.

Buy Terms

| 52.217-10 Reverse Auction | (a) Definitions. As used in this provision— Reverse auction means the process for obtaining pricing, usually supported by an electronic tool, in which offerors see competing offerors'' price(s), without disclosure of the competing offerors'' identity, and have the opportunity to submit lower priced offers until the close of the auction.' Reverse auction service provider means a commercial or Government entity that provides a means for conducting reverse auctions when acquiring supplies or services to be used by the Government.' (b) Reverse auction. The Government intends to conduct a reverse auction under this solicitation to award a contract or blanket purchase agreement.' (c) Offeror agreement. By submission of a quote or proposal in response to the solicitation, the Offeror agrees to participate in the reverse auction and agrees that the Government may reveal to all Offerors the offered price(s) in the auction, without revealing any Offeror''s identity, except for the awardee''s identity subsequent to an award resulting from the auction. The Offeror may withdraw its agreement to further participate in the process by withdrawing its offer before the close of the auction by notifying the Contracting Officer via the contact method identified in the solicitation.' (d) Only one offer. If the reverse auction produces only one offer, the Government reserves the right to cancel the auction.' (e) Release of information. The Government may use a reverse auction service provider to conduct the reverse auction. Any price or proposal information or source selection information received by the reverse auction service provider in relation to the reverse auction shall not be released, outside of the Government, unless otherwise required by law. However, this does not prevent the Government from revealing to all Offerors the offered price(s) in the auction, without revealing any Offeror''s identity. Price or proposal information includes, but is not limited to—' (1) Contractor bid or proposal information, as defined at Federal Acquisition Regulation 3.104-1; and' (2) Information identified by the Offeror as restricted from duplication, use, or disclosure—in whole or in part—for any purpose other than to evaluate the Offeror''s price or proposal.' | AVAILABILITY OF FUNDS (APR 1984) | Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. | Performance Evaluation | Performance will be evaluated based on timely communication with the Contracting Officer, timely delivery, completeness of delivery and adherence to National Menu Specification/Requested Specification. Poor Performance will be subject to a CPARS entry as well as an alert placed in Unison Marketplace on your account. Past performance will be a factor in the successful winning of the award. |

| National Menu Specifications | Failure to comply with the National Menu Specifications will result in your quoted item not being considered for award. | Formal Reminder and NOTICE | The Government reserves the right to make payments using either Electronic Funds Transfer (EFT) or Government Purchase Card. Awards exceeding $10,000.00 will be accomplished through issuance of a Purchase Order. All awards under $10,000.00 will be accomplished via the Government Purchase Card. Referencing FAR 52.212-4(a) – Supplies shall be “nonconforming” if: 1 – The supplies are recalled by the producer. 2 – A local, state, or federal agency issues a public health alert regarding the supplies. 3 – The facility or farm from which the supplies originated or were processed is found to have violated applicable local, state, or federal health and safety standards. This includes, but is not limited to, the Federal Meat Inspection Act, Poultry Products Inspection Act, or the Food Safety and Inspection Services directives and regulations. |
| Past Performance – Go/No-Go Evaluation | The Government will evaluate the Offeror’s past performance on a Go/No-Go basis. The assessment will be based on the following criteria: • Timeliness of Deliveries: The Offeror must demonstrate a consistent record of on-time deliveries. Documented instances of late deliveries, including Contractor Performance Assessment Reporting System (CPARS) evaluations and communications with other Contracting Officers, will be reviewed. A history of substantial delivery delays will result in a "No-Go" determination. • Order Accuracy and Completeness: The Offeror must show a track record of delivering complete and accurate orders. Evidence of recurring issues such as missing or incorrect items—supported by customer complaints, returns, or input from other Contracting Officers—will be considered. A pattern of incomplete or inaccurate deliveries will result in a "No-Go" determination. |
