Per my understanding this is an SCA contract which means all employees must get a minimum wage of $15hr plus health and warfare which is an additional $4.80hr. A minimum total of $19.80hr per employee?
Response Received:
Yes. FAR clause 52.222-41 Service Contract Labor Standards applies to this requirement. The applicable wage determination (for the Texas County of Hidalgo) has been included with the solicitation as “Sol_Att_2”. Per FAR 52.222-42 (also included and applicable to the solicitation), the class of service employee expected to be employed under the contract is “Food Service Worker”.

Will the government clarify delivery/serving requirements? If we are required to serve, will we be required to clean? Is it buffet style, or do we pass out all 500+ meals? We are not sure if we will need 2 of 4 or more people to stay if serving is required, unless it is clear what our responsibilities are. Please refer to defense catering contracts of the same scope for examples of full PWS'.

In accordance with Statement of Work Section 4.3: There are no loading docks or other loading/unloading or serving facilities at the delivery location and the Contractor shall be responsible for the proper offload and set-up/tear-down of materials and supplies needed for the food services. Food distribution may consist of handing food out to migrants, staging food on a table for migrants to obtain, or other similar method. Upon award, specific method of food services will be agreed upon by Contractor and the location being serviced to determine setup location within the facility. Government personnel and/or equipment will not be available to assist in offloading and unloading of materials. At the completion of meal services, the Contractor shall secure, account for, and remove all equipment (such as carrying containers), supplies, and as much waste as possible. The distribution area shall be clean and free of any trash/debris prior to leaving for the day.

Yes, as long as the juice is labeled “100% fruit juice” in accordance with SOW section 4.1.

I did not see a requirement for labels on the food items. Please advise if we need to label the food.

Individual labeling of meals is not required, but is recommended. All meals served shall meet the strict FDA standards for time, quality and nutritional value, including certification for same. Periodic inspection requirements may be hampered if criteria are not able to be proven met.

Meal services shall be provided in a secured, law-enforcement detention facility environment. Service providers shall be required to be escorted at all times during service periods.

1) Can you elaborate on what your vision is for the disbursement of meals after the delivery? Would contractor have to bring their own tables to distribute the meals? How many feeding station will be required at one time? 2) Will after hour orders need to be distributed by the contractor after delivery or will those be handled by the BP? Are after hour meals expected to be hot?

Exact meal serving times shall be outlined and agreed upon by the Contractor and individual location staff after award. Meal services outside of those periods, e.g., meals for late arrivals as required by the Government, may be outlined and agreed upon after award. However, meal services performed outside the specified timeframes when not directed by the Government shall be considered negative performance and subject to contractual remedies as determined by the Contracting Officer.

1) Potable water is available at the facility, however no food preparation is to be completed onsite. Meals shall be prepared off site, and then served at the facility. 2) There is limited greywater disposal access on-site. The contractor shall remove as much greywater as possible that may be generated during food services after food services are completed for the day. 3) There are trash containers available at the facility. Waste removal on the premises shall be kept to a minimum by the food services provider due to the overwhelming requirements which already exist for same. The Contractor shall remove as much waste materials as possible after food services are completed for the day. 4) The anticipated period of performance start date is 09/28/2022.

Can you please explain the Statement of Work Appendix One Exhibit 4 (d) – in this document it talks about the Flores Agreement. It talks a lot about Juvenile meals. Is this information supposed to be included with this statement of work or is that an error. I just wanted to confirm are you looking for adult or juvenile meals? As the statement of work asks for meals Males and Females 19-30 years. Please advise.
Response Received:
This requirement is for the provision of meal services for adults only, as outlined in the Statement of Work. There is no requirement for juvenile meals. Although there is no requirement for juvenile meals at this time, the requirements of SOW 10.2 have been included due to the fact that the Ursula facility is a designated Juvenile Priority Facility and falls within an area covered as part of a recent Federal court order. The requirements of Appendix 1 would only be applicable when and if juvenile meals were to be served. If juvenile meals were to be added to the contract at a later date, it would be accomplished via a negotiated bilateral modification between all parties, and Appendix 1 would be applicable to those juvenile meals.
