Dear Contracting Officer, Federal Prison Industries, Inc. (FPI or trade name UNICOR) is a government corporation, established by Congress in 1934, which is under the management of the Federal Bureau of Prisons (BOP) and United States Department of Justice (DOJ). Since its inception in 1934, FPI has operated in the federal marketplace pursuant to the mandatory source provision in its enabling statute, 18 U.S.C. § 4124. In fulfilling this obligation we have determined that the items advertised as part of your current Solicitation fall within UNICOR’s schedule of mandatory supplies. Please forward a copy of your RFQ direct to my attention so that a proposal may be drafted and submitted in accordance with Title 18. Thank you for your consideration. Sincerely, Aaron Tucke
Response Received:
Based on a Memorandum from the Office of the Under Secretary of Defense, dated 25 April 2023, FSC Code 8465 is listed as a Classification which FPI has a greater than 5% Significant Market Share on. Below is the paragraph from the memorandum verbatim as to why competition is required. You may submit a proposal for this solicitation; however, this procurement is not required to go directly to UNICOR/FPI. Thank you. The list of product categories for which FPI’s share of the DoD market is greater than five percent is based on FY 2022 data from the Federal Procurement Data System and is attached, this year’s list is not the same as last year’s. The product categories and the products within each of the identified product categories must be procured using competitive (or fair opportunity) procedures in accordance with Defense Federal Acquisition Regulation Supplement 208.602-70.
